On Sept. 18 — we saw Marilyn Manson sentenced to 20 hours of community service in New Hampshire for a misdemeanor charge.
It was the first official public appearance since the shock rocker – real name Brian Warner – was accused of abuse by Evan Rachel Wood and others in February 2021 however this case in particular is not connected to Wood.
Manson’s appearance was for a sentencing hearing in Laconia, New Hampshire for an Aug. 18, 2019 incident that occurred involving photographer Susan Fountain at a concert in Gilford, New Hampshire.
Fountain was hired to film the concert with footage broadcast on large screens for the audience to enjoy. The setup for the event was like any standard rock concert with a pit area closest to the state. Foundation was positioned on a platform capturing a performance of The Nobodies when Manson crossed the stage — approaching and blow a combination of spit and nasal spray at the camera lenses and some sprinkled onto Fountain.
Susan Fountain was aghast and unable to continue her duties filming the concert. She filed a report with the local Gilford Police Dept. as well as the venue managers.
After the “bodily fluid attack”, Fountain sought medical treatment and testing of any potentially hazardous bodily fluids for communicable diseases. She was tested again months later to ensure she incurred no damage to her health.
Marilyn Manson Sentenced to 20 Hours of Community Service in New Hampshire
Reviewing the case and Manson’s lack of prior criminal record, county prosecutors charged Manson with two misdemeanors and sentenced him to a $1200 fine and 20 hours of community service – which he can complete in his home state of California. He pled no contest and waived his right to appeal.
Videographer Susan Fountain addressed the court at the sentencing hearing with a brief victim impact statement where she shared that what Manson did to her is “the most disgusting thing a human being has ever done.”
She continued that she understood the incident was not a big criminal charge – but her intent was for Manson to receive a sentence that would make “think twice” before doing something like this again.
Her intent clearly extends beyond wanting Manson to be merely sentenced for the misdemeanor, however.
Two years to the day after the Aug. 18, 2019 concert incident, Susan Fountain filed a civil action on Aug. 18, 2021 in Los Angeles County, California against Manson for:
- Assault
- Battery
- Intentional Infliction of Emotional Distress
Susan Fountain’s lawsuit details how she responded to and was horrified by what occurred while filming the 2019 Marilyn Manson concert.
She requests a jury trial and seeks monetary damages for the treatment of her “emotional and mental injuries” in an amount to be determined by a jury – if the case progresses to trial.
Her lawsuit was previously dismissed in Feb. 2023 but re-opened when Fountain’s counsel cited a clerical error as reason for not appearing at the assigned court date. Since the case was re-opened, a July 2023 hearing was set that Susan Fountain motioned to delay till this fall for review by a judge.
Within her complaint, Susan Fountain claims that Manson’s actions had intent to “vex”, injure and annoy her and from the 10-second encounter she has suffered:
- Emotional distress
- Mental distress
- Anxiety
- Nervousness

Marilyn Manson appeared in NH court today to plead ‘no contest’ to a 2019 misdemeanor over nasal spray a photographer during a performance she was filming from the pit.
She’s also filed a personal injury lawsuit against him.
